Sailing Is A Complex Activity That Requires Physical And Mental Effort. Depending On The Weather, Sailing Can Be Fun Or Dangerous. Sailing Also Faces Many Risks That May Occur Not Only Due To Natural Factors Or Weather, But Other Factors Such As Engines And Local Factors That Will Affect The Trip.

It Is Important To Understand The Possibility Of Risks Occurring During The Trips That We Cannot Fully Control, The Eternity Team Will Make Every Effort To Minimize Any Risks And Always Focus On Safety And Precautions. Please Read Carefully Every Point We Mention, Because We Will Ignore Complaints Regarding What We Have Mentioned In The Terms & Conditions.

Rates

• Infants (Under 2 Years Old): Free Of Charge.
• Toddlers (2-5 Years Old): 50% Of The Normal Rate.
• Children (Over 5 Years Old): Full Price.

Payment Terms

• A 30% Deposit Applies To Guarantee The Booking, Payable No Later Than 3 Days (High Season: June–September) Or 5 Days (Low Season: October–May) After Receiving Confirmation. The Remaining Balance Is Due 7 Days Prior To The Sailing Date.
• Any Additional Bank Charges Incurred For Overseas Money Transfers Are The Responsibility Of The Guest/Agent; We Require Receipt Of The Full Amount As Stated In The Invoice. In The Event That The Guest Settles The Payment Onboard Using A Credit/Debit Card Through The Edc Machine, All Additional Bank Charges Shall Be The Responsibility Of The Guest.
• Full Payment Of The Sailing Price Must Be Made Before The Boat Departs From The Port Of Origin. If A Guest/Agent Has Not Paid The Full Amount By The Time Of Departure, That Guest/Agent Will Not Be Allowed To Board, While Other Confirmed And Fully Paid Guests May Proceed With The Voyage As Scheduled.

Cancellation

• Cancellation By The Guest Is Non-Refundable, But The Booking Can Be Transferred To Another Person (Substitute Guest)
• In The Event Of Cancellation Due To Official Government Travel Restrictions Or Flight Cancellations Related To A Pandemic, The Terms Set Out Under The Force Majeure Clause Shall Apply. All Payments Made Will Be Retained As A Deposit And Can Be Used For Rebooking Within 12 Months From The Original Travel Date, Subject To Availability.
• If No Rebooking Is Made Within This 12-Month Period, All Payments Will Be Forfeited With No Refund.

Liabilities

• By Sending A Payment, The Guests And Agent Certify To Pay Compensation At Full Current Market Value To Eternity For Any And All Damage Or Loss Of Property And Equipment Belonging To Eternity Due To Fault Or Negligence Guests/ Passengers, And From Any Direct Or Indirect Claims, Arising From Any Injury, Illness, Death, Damage To Or Loss In Any Way During Embarkation, Carriage, Activities During The Cruise And Disembarkation.
• All Activities During The Cruise Are Entirely At The Passenger‘S Own Risk.
• Eternity Shall Not Be Liable For Any Loss, Damage, Injury, Illness, Or Death, Except Where Such Loss Is Directly Caused By Eternity’s Gross Negligence Or The Vessel Being Deemed Unseaworthy Under Applicable Law.

Booking Condition

• The Booking Category Is Confirmed After We Receive The Deposit Payment, And We Reserve The Right To Cancel The Reservation If No Payment Is Made.
• Rescheduling Of The Trip Is Available With A Minimum Of 30 Days’ Notice In Low Season And 45 Days’ Notice In High Season Prior To The Travel Date. Less Than This Period, The Applicable Cancellation Fee Will Apply.
• Deposits Are Non-Refundable. If The Requested Reschedule Date Is Not Available, The Deposit Will Be Retained For The Next Booking Within 12 Months Of The Original Trip Date. If No Replacement Booking Is Made Within This 12-Month Period, The Deposit Will Be Forfeited With No Refund.

Labuan Bajo – Lombok

• Check-In 20:00 – 21:00 (Local Time)
• Check-Out 22:00 – 23:00 (Local Time) (Day 4) Or 08:00 (Day 5)
• Early Check-In May Be Available From 18:00 For Luggage Drop Only, As The Vessel Will Still Be Under Preparation. Please Kindly Understand If The Check-In Process May Be Delayed Due To These Preparations.

Lombok – Labuan Bajo

• Check-In 13:00 – 14:00 (Local Time)
• Check-Out 12:00 – 13:00 (Local Time)
• All Check-In And Check-Out Times Are Indicative And May Vary Depending On Sea Conditions, Weather, Or Operational Events During The Trip. We Cannot Guarantee Exact Times And Kindly Request Guests’ Understanding In Case Of Delays Caused By Such Circumstances.

Itineraries

• Eternity Reserves The Right, At Its Sole Discretion And That Of The Captain Of The Boat, To Alter Or Deviate From The Advertised Itinerary Or Route Without Liability For Damages Or Refunds Of Any Kind, Where Such Changes Are Caused By Weather Conditions, Force Majeure, Assisting Other Boats In Distress, Saving Of Life At Sea, Or Other Extraordinary Circumstances Beyond Our Control. Such Deviations Shall Not Entitle Passengers To Any Claims Or Refunds.
• Eternity Will, However, Make Every Reasonable Effort To Ensure That Passengers Reach Their Port Of Disembarkation On Time For Their Onward Flights.

Guest Responsibility

• For The Safety And Security Of All Passengers, The Vessel, And Its Crew, All Guests/Agents Agree That The Vessel’s Officers May, Where Reasonably Necessary And In Accordance With Applicable Law, Search A Guest, Their Suite/Stateroom, Or Property To Ensure The Safety And Security Of Passengers, The Vessel, And Its Crew, In The Event Of Any Reported Incident, Including But Not Limited To Crime, Personal Injury, Illness, Or Damage To Property.
• The Vessel’s Officers May Also Preserve Evidence Of Such Incidents In Order To Comply With Law Enforcement Requirements And To Conduct Any Necessary Investigation Aboard The Vessel, In Accordance With Applicable Law.

Replacement Vessel

• If A Technical Issue Occurs Before Departure Or While The Vessel Is Still Within The Labuan Bajo Area, Eternity May Arrange For A Replacement Vessel Or Alternative Trip, Subject To Availability. Any Replacement Or Rearrangement Will Be Discussed With The Guest/Agent Prior To Departure. If No Replacement Vessel Or Alternative Trip Is Available, Eternity May Offer To Reschedule The Trip Within 12 Months Of The Original Travel Date. No Cash Refund Will Be Provided.
• Once The Voyage Has Commenced And The Vessel Has Left The Labuan Bajo Area, Replacement Of The Vessel Is No Longer Possible. In Such Cases, The Captain Has Full Authority To Make Decisions Regarding Repairs, Delays, Or Changes To The Itinerary In Order To Ensure The Safety Of All Passengers And Crew.
• In The Event Of Partial Engine Failure, Where The Vessel Can Still Operate At Reduced Speed, The Captain May Adjust The Itinerary At His Discretion. Such Changes Are Made Solely For Safety Reasons And Shall Not Entitle Guests To Any Refund, Claim, Or Compensation.

Bad Weather Condition

• In The Event Of Bad Weather, Considered A Form Of Force Majeure, The Trip Will Be Rescheduled Within 12 Months Of The Original Travel Date, Subject To Availability. Alternative Itineraries Or Adjusted Departure/Arrival Times May Also Be Offered On The Same Day To Minimize Disruption. No Cash Refund Will Be Provided; Rescheduling Shall Be The Sole And Exclusive Remedy For Cancellations Due To Weather.

Feedback / Complaints

• We Welcome All Feedback, Positive Or Negative, As An Opportunity To Improve Our Services. However, Please Note That Certain Matters Beyond Our Control — Such As Weather Or Sea Conditions, Natural Sightings (E.G., Komodo Dragons Or Manta Rays), Taste Of Food, Or Other Subjective Perceptions — Cannot Be Considered As Valid Grounds For A Complaint, Although We Will Review And Take Them Into Consideration.
• We Strive To Provide The Best Service Possible, But As No Service Is Perfect, There May Be Occasional Shortcomings (E.G., Areas Not Cleaned To Expected Standards, Minor Damage, Amenities Unavailable, Or Changes In Itinerary). We Kindly Ask Guests To Communicate Any Issues Immediately To Our Crew During The Trip, So That Corrective Action Can Be Taken On The Spot.
• Any Formal Feedback Or Complaints Should Be Submitted No Later Than 2 Days After The Trip Has Finished. Eternity Will Respond Promptly To All Timely Feedback. Complaints Submitted Beyond This Period Will Not Be Considered.

Force Majeure

• Force Majeure Shall Mean Any Event Beyond The Control Of The Parties, Which Could Not Reasonably Have Been Foreseen Or Avoided, Including But Not Limited To: War Or Hostilities, Natural Disasters, Exceptional Storms, Perils Or Accidents At Sea, Acts Of State, General Strikes, Technical Failures, Or Pandemics. Economic Or Commercial Circumstances Affecting Financial Profitability For Either Party Shall Not Constitute Force Majeure, Unless Caused By Perils Of The Sea Or A General Strike Of The Boat’s Crew.
• If Eternity Or The Charterer Must Cancel Due To Force Majeure, Including Pandemics, All Amounts Paid Will Be Retained As A Deposit And The Itinerary May Be Rescheduled Within 12 Months From The Original Travel Date, Subject To Availability. If No Rebooking Is Made Within This Period, All Payments Will Be Forfeited With No Refund. Additionally, The Captain Reserves The Right, At His Sole Discretion, To Cancel Any Charter Without Refund For Reasons Including But Not Limited To: Over-Intoxication, Unconsciousness, Aggravation Of Pre-Existing Injury, Illegal Drug Use, Unruly Or Reckless Behavior, Perceived Risk To The Operation Of The Vessel Or To Others, Criminal Acts, Violations Of Local Law, Or Behavior That Distracts The Captain Or Crew From Their Duties. In Such Cases, Guests Will Be Informed By The Eternity Team As Soon As Possible, And No Reimbursement Shall Apply.
• By Booking With Eternity, The Guest/Agent Acknowledges And Accepts All Inherent Risks Of Sea Travel And Factors Involved In The Journey. While It Is Not Possible To List Every Potential Risk, Examples Have Been Provided To Give Guests/Agents A Clear Understanding Of The Nature Of Such Risks. By Proceeding With The Booking, The Guest/Agent Confirms That They Have Read, Understood, And Agreed To All Terms And Conditions Stated Herein.
